Chapter 15 of California’s Proposition 64 outlines restrictions for advertising marijuana. Radio, cable, print, and digital ads can only be displayed where at least 71.6% of the audience is expected to be over the age of 21. The ads also cannot be posted within 1,000 feet of day care centers, schools between kindergarten through 12th grade, playgrounds or youth centers.

Thank you Stephanie. You seem to know the exact law. Are you with the city or cannabis industry ? Was this sign legally permitted by NC?

I live by there and there are no daycares or schools or playgrounds or youth centers...so I don't know how you would know the ages of the people in the neighborhood.. don't know if people really notice it with all the other ads around it..

The billboard is considered to be nonconforming in that it was legally established, but is no longer a permitted use (offsite advertising - aka billboards - are no longer permitted on private property, but only on City-owned properties under certain conditions). Therefore, the City does not have the authority to condition or regulate the messages on these signs. They are basically subject to state federal (first amendment) regulations.

Ted G, no...I just looked it up and copy/pasted what i found. Since the billboard is city property and has to permit the advertisement, I would assume NC knows whether cannabis can be advertised at that exact location.

The billboard is on private property, so the City does not regulate what is advertised. We used to have an issue with other billboards near schools advertising alcohol, but the same was true for them as for the cannabis business. Cannabis is legal in the state, so there is no legal reason to prohibit that as far the City is concerned.
